This is the Privacy Policy of MetroSwitch Technologies, Inc. (“MetroSwitch”, “we”, “us”, or “our”) and its affiliated companies with which we, directly or indirectly, share common or partial ownership regarding our practice of collecting, using, disclosing, or selling information (“Information”) from visitors to our website (“Site”) or Customers that purchase our products. This Privacy Policy is provided to inform you about the limited information that we collect, and how we use it and protect it.
METROSWITCH REVIEWS THIS POLICY PERIODICALLY AND MAY MODIFY THIS PRIVACY POLICY AT ANY TIME WITHOUT NOTICE. THEREFORE, IT IS IMPORTANT FOR YOU TO REVIEW THIS PRIVACY POLICY FROM TIME TO TIME TO BECOME AWARE OF ANY MODIFICATIONS. METROSWITCH WILL NOTE THE DATE Of THE LAST MODIFICATION AT THE END OF THIS POLICY. ALL MODIFICATIONS WILL BE RETAINED IN ITS ARCHIVES AT www.metroswitch.com/legal/archives.
1. Does MetroSwitch collect Personal Information from Site visitors or Customers that purchase our products?
No. “Personal Information” is information that personally identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a consumer, such as name, alias, address, telephone number, unique personal identifier, online identifier, or email address. MetroSwitch uses Google Analytics to collect and process data that does not contain personally identifiable information regarding visits to Sites to assist it in its marketing plans. To learn more about Google Analytics visit "How Google uses information from sites or apps that use our services" (located at www.google.com/policies/privacy/partners/, or any other URL that Google may provide from time to time). MetroSwitch uses information provided by Google Analytics internally for marketing analysis and never discloses it outside MetroSwitch.
MetroSwitch is not a data broker. It does not use Automated Decision-Making Technology in any way that involves decisions about consumers based on Personal Information.
2. Who does this privacy policy apply to?
The MetroSwitch Privacy Policy applies to actual Customers utilizing MetroSwitch products as well as visitors and potential customers who access and use any Site to obtain information about the services or products offered by MetroSwitch or through affiliated companies with which we, directly or indirectly, share common or partial ownership.
3. What type of Information do we collect?
We may have collected Information that you provide on a voluntary basis when you use the Site or enter into a contract and utilize MetroSwitch products (“Information”). We may collect network monitoring data and industry-standard communications metadata to enable us to maintain the security and agility of our internal networks. We may collect geo-location information to determine the most effective network routing for products. For visits to Sites, we may collect log data about you for your use of any Site including Internet Protocol (“IP”) address, Internet Service Provider, browser type, referring/exit pages, the files viewed on our site (e.g., HTML pages, graphics, etc.), operating system, date/time stamp, and/or clickstream data to analyze trends in the aggregate and administer the Site. Some of the Information that we collect may be stored in the cloud. We may continue to collect this Information.
4. Do you use passive means to collect Information?
Sometimes. We may also collect Information about you by using cookies, web beacons, identifiers for mobile devices, or similar technologies when you visit our Sites or utilize our products. By using our Site, or utilizing our products, you provide this Information on a voluntary basis.
5. How do we use the Information that we collect?
We use the Information we collect from you for a range of legitimate business interests and functional purposes that enable our ability to operate. We may use this Information to:
- Manage, administer, operate, protect, and maintain the Site and our products and services;
- Improve your use of the Site;
- Investigate and prevent fraudulent and illegal activities such as unauthorized access to the MetroSwitch Site or its products;
- To determine the most effective network routing.
- More effectively market our services and products based upon aggregate analysis;
- Ascertain specific customers’ needs to personalize our messages to customers.
6. Do you share the Information that you collect with third parties?
No. Information about our customers and Site visitors is important to our business, and we do not sell it to others. When we employ contractors to provide services on our behalf, we do so by written contract that prohibits them from selling any Information that we may acquire from you, or retaining, using, or disclosing it for any purpose other than for the specific purpose of performing the services specified in the contract. MetroSwitch may need to share the Information we collect, for legitimate business purposes with a limited number of third parties, including:
- Any parent, affiliate, or subsidiary of MetroSwitch;
- Business partners, contractors, vendors, and authorized third party agents, to:
- Operate, deliver, improve, and customize our services and products;
- Provide support and technical services;
- Provide marketing and other promotional communications to customers or Site visitors who request it;
- Respond to requests from law enforcement agencies, regulatory or governmental bodies, or other third parties to comply with any legal obligation; protect or defend our rights, interests, or property or that of third parties; prevent or investigate wrongdoing in connection with the Site or our services and products;
- Facilitate any prospective or actual, sale, merger, acquisition, financing, or reorganization of our business.
We do not sell Information or provide it to any third parties for their direct marketing purposes.
7. How long do you retain the Information that you collect?
We will retain the Information that we collect for no longer than is necessary to fulfill the purposes for which the Information was originally collected unless a longer retention period is required or permitted by law, for legal, tax or regulatory reasons, or other legitimate and lawful business purposes. Where we have no ongoing legitimate business interest to process your Information, we will delete it.
8. Do You honor Do Not Track Requests?
No.
9. Does this Privacy Policy apply to other websites accessible through your Site?
No. We may in some cases include links on our Site to third party websites. In these cases, we are not responsible for such third parties’ privacy practices or content, and we recommend that you review their privacy policies to understand their privacy and Information collection practices.
10. What are my privacy rights?
- For EU residents. We do not target or collect data specific to citizens of the European Union (“EU”). Occasionally an EU resident may access our Site from the EU and we may collect Information from this citizen for our legitimate business interests, as stated in our response to Question 5. But, as noted above, the Information we have collected about you does not contain Personal Information, so you do not have the right to review or correct it. But if you have a question about our data collection, please send your inquiry to our contact information in Question 12. We will attempt to respond to your request within 30 days. You also have the right to complain to your local data protection authority at any time.
- Rights under state consumer data protection laws. Because the Information that we may collect from you is not Personal Information state consumer data protection laws do not apply. MetroSwitch does not provide, sell, or market products or services designed for use by children under the age of 16, or knowingly collect Personal Information from or about children under the age of 16.
11. How do you protect the security of the Information that you collect?
MetroSwitch cares about the protection of the Information that you provide to us. We use industry standard technology to do so, in addition to limiting its dissemination to third parties who have a need to know, subject to a contract that protects Personal Information. Of course, no one can guarantee that any data transmission on the Internet will be totally secure. It is important for you to protect against unauthorized access to your password and to your computer. Whenever you are using a shared computer, be sure to sign off from the Site once you have finished using it. We do store, in a secure format, Information that you provide to us electronically on servers located within the United States. If you are concerned that your privacy may have been breached, please contact us immediately as provided below.
